Social Media Minimum Age Obligation (Ref: 294/25)

To support online industry and the general public in preparing for the upcoming Social Media Minimum Age (SMMA) obligation, eSafety has released guidance on which platforms are likely to be classified as age-restricted social media services. From Wednesday 10 December 2025, these services will be required to take reasonable steps to prevent Australians under the age of 16 from holding social media accounts.

As part of this preparation, eSafety has reviewed a broad range of online services to determine whether they meet the criteria for age-restricted social media platforms under the new legislation. The updated list, current as of 21 November 2025, identifies which services are expected to fall under the SMMA obligation and which are not.

This guidance is intended to help platforms plan for compliance, assist parents and carers in understanding what the changes mean for young people, and provide clarity to educators and the broader public. By outlining these classifications ahead of time, eSafety aims to support a smooth transition as Australia moves toward stronger protections for children online.

To view the lists of social media platforms that will and will not be restricted, and for further information on Obligations on service providers, go to: Which social media platforms are age-restricted? | eSafety Commissioner

Updated eSafety Early Years resources (Ref: 288/25)

eSafety has updated its Early Years resources to support educators and services in creating safe online environments for young children.

New legislation has come into effect in the Early Childhood Education and Care sector, strengthening child safety and transparency.

In response, eSafety has updated its Early Years resources to support educators and services in creating safe online environments for young children.

Save the date: The eSafety Early Years team is hosting an Early Years online safety information session on 18 February 2026 to mark Safer Internet Day.

Important changes to NSW Workers Compensation Scheme (Ref: 287/25)

On 18 November, the NSW Parliament passed an amended Workers Compensation Legislation Amendment Bill 2025 which was assented to on 24 November. A number of key changes were made. The Government now needs to determine when these changes will take effect.

Key changes:

  • New definitions for bullying, excessive work demands, and racial harassment in relation to psychological injuries;
  • Cap of 130 weeks for weekly payments for primary psychological injuries except where whole person impairment is 21% or more;
  • Restriction of WPI assessments to only one ‘principal assessment’ (except in certain circumstances) which may be made only by an approved medical assessor;
  • Replacement of ‘reasonably necessary’ test for medical treatment with the higher test of ‘reasonable and necessary’.
